Under the Personal Health Information Protection Act (PHIPA), you have the right to control how your personal health information is collected, used, and disclosed. This includes:
- Consent: Your information can only be collected, used, or shared with your knowledge and consent, except in specific circumstances permitted by law. You can withdraw your consent at any time, without the fear of retaliation.
- Access and Correction: You may request access to your records and ask for corrections if you believe the information is inaccurate or incomplete.
- Restrictions: You can place limits on how your information is used or disclosed, for example by withholding consent for certain uses.
- Transparency: You are entitled to know why your information is being collected and how it will be used.
- Complaints: If you believe your rights under PHIPA are not being respected, you may file a complaint with the Information and Privacy Commissioner of Ontario (online or by phone: 1-800-387-0073).
As the Substitute Decision Maker, you have the right under PHIPA to control how the individual’s health information is collected, used, and disclosed. Consent is required for most uses, and you may place restrictions or withdraw consent at any time, without the fear of retaliation.
